The
idea of “minority fiqh” is a clever ruse to get Muslims to water down their
obversance of the Shari’a. Islam is a universal faith, relevant and applicable in
all times and places. This division of the world into the “abode of Islam” and
the “abode of unbelief” has no clear basis in the divine revelation. It is
actually a construct of medieval jurisprudence. The Prophet (sall Allahu alayhi
wasallam) said:
فَاعْلَمُوا أَنَّ الأَرْضَ لِلَّهِ وَرَسُولِهِ
“Know that the Earth belongs to Allah and His
Apostle”
(Sahih al-Bukhari)
The
great imam of ahl as-Sunna, Imam al-Hasan b. Ali al-Barbahari (rahimahullah)
(d. 329 H), did not recognize the division of the world into two opposing
abodes, but wrote:
واعلم بأن الدنيا دار إيمان وإسلام
“Know that the world is a place of faith
and Islam”
(Sharh as-Sunna #45):
