Read
the following and realize how the Hanafi madhhab gives preference to
recovery of wealth, even a single Dirham, over following the Sunnah.
According to the Hanafis, it is forbidden to open the grave of a dead
person who was buried incorrectly (not facing the Qiblah). In other
words, the Hanafis forbid opening the grave of a dead person who was
not buried according to the Sunnah, in order to rectify his/her
burial. However, the Hanafis say it is allowed to re-open the grave
of someone in order to recover any wealth or item, even a single
Dirham!
لَوْ
وُضِعَ
الميت لِغَيْرِ
الْقِبْلَةِ
...وَأُهِيلَ
عَلَيْهِ التُّرَابُ لَمْ يُنْبَشْ
...وَإِن
وقع فى القبر متاع فعلم بذلك بَعْدَ
مَا أَهَالُوا عَلَيْهِ
التُّرَابُ
يُنْبَشْ...وَلَوْ
كَانَ المَال درهما
اگر
میت کو قبلہ رخ نہ رکھا جاۓ اور اس پر مٹی
ڈال دی جاۓ تو دوبارہ قبر نہ کھودی جاۓ
اور اگر قبر میں کوئی شے گر پڑے اور مٹی
ڈالنے کے بعد پتہ چلے تو قبر کو کھودا جاۓ۔
چاہے وہ ایک درہم ہی کیوں نہ ہو۔
Translation:
“If the mayyit (dead) was not placed in the grave facing the
Qiblah, and he/she was buried in that condition, then to re-open the
grave is not allowed. And if something fell into the grave and it
became known after burial, then it is allowed to open the grave in
order to recover it, even if it was a single Dirham.”
